Information on the operation of cookies – ex art. 13 EU Regulation 679/2016

In the following, we transparently inform you about the operation of so-called cookies on this website (hereinafter “Site”) in compliance with Directive 2009/136/EC and related order of the Privacy Guarantor No.229/2014.

1. Definition of “cookie”

   Cookies are short text fragments (letters and/or numbers) sent by the Site and stored by your browser on your device (computer, tablet, smartphone) and contain information to be reused during the same visit to the site or later, even days. Cookies are stored based on your preferences.
   In addition, with the introduction of HTML5, various forms of local storage and similar technologies are available, such as, for example, web beacons and transparent GIFs, which can be used to collect information about user behavior and choices and the use of services.
   In this document, for simplicity, we will use the term “cookies” to refer to cookies and all similar technologies.
   Typically, cookies can be installed:

   • directly by the owner and/or manager of the website (so-called first-party cookies);
   • by managers unrelated to the website visited by the user (so-called third-party cookies). Unless otherwise specified, it is recalled that these cookies fall under the direct and exclusive responsibility of the same operator. Further information on privacy and their use can be found directly on the respective operators’ websites.

   This website may use, also in combination with each other, the following types of cookies classified according to the indications of the Privacy Guarantor and the Opinions issued in the European context by the Working Group ex art. 29 of the GDPR:

   1. Session cookies that are not stored persistently on the user’s computer and are deleted when the browser is closed, strictly limited to the transmission of session identifiers to enable the safe and efficient exploration of the site while avoiding the use of other computer techniques potentially prejudicial to the privacy of users’ browsing;
   2. Persistent cookies that remain stored on the computer’s hard drive until they expire or are deleted by users/visitors. Through persistent cookies, visitors accessing the site (or any other users employing the same computer) are automatically recognized each time they visit. Visitors can set their computer’s browser to accept/reject all cookies or to display a warning whenever a cookie is offered so that they can consider whether to accept it. Users can, however, change the default configuration and disable cookies (i.e., block them outright) by setting the highest level of protection;
   3. Technical, these are the cookies used to authenticate oneself, take advantage of multimedia content, or allow the choice of navigation language. Therefore, acquiring the user’s prior and informed consent is generally unnecessary. Also included in this case are cookies used to statistically analyze access/visits to the site only if they are used exclusively for statistical purposes and through the collection of information in aggregate form and analytics cookies that do not allow unique identification (for example, by masking the fourth component of the IP) by limiting themselves only to data for traffic monitoring (geographic area, time slot, pages visited), without comparison with other data that actually allow unique identification;
   4. Non-technical, these are all cookies used for profiling and marketing purposes. Their use on users’ terminals is prohibited unless they have been adequately informed and given valid consent according to the opt-in technique. These types of cookies are, in turn, groupable according to the functions they perform in:
      • Analytics cookies which are used to collect and analyze statistical information about access/visits to the website. In some cases, associated with other information such as credentials entered for access to restricted areas (one’s e-mail address and password), they can be used to profile the user (personal habits, sites visited, content downloaded, types of interactions made, etc.);
      • Widgets. All those graphic components of a program user interface fall into this category, intended to facilitate the user’s interaction with the program. For example, Facebook and Twitter cookies are widgets.
      • Advertising, which are cookies used to advertise within a site fall into this category. Google and Tradedoubler fall into this category.
      • Web beacons, which are code snippets that allow a website to transfer or collect information by requesting a graphic image, fall into this category. Websites may use them for various purposes, such as analyzing website usage, monitoring and reporting activities on advertisements, and personalizing advertisements and content.

3. Cookie management

   Users can also decide whether or not to accept cookies using their browser settings.
   The setting can be defined specifically for different sites and web applications. In addition, the best browsers allow you to define different settings for “proprietary” and “third-party” cookies. Through the options menu of the browser you are using, you can manage and define whether or not to accept the different types of cookies and proceed to their removal.
   Warning: total or partial disabling of technical cookies may affect the functionality of site areas reserved for registered users. On the contrary, the usability of public content is also possible by disabling cookies completely. Disabling “third-party” cookies does not affect navigability in any way.

4. Communication and disclosure of data

   Data collected using cookies may be processed only by specifically appointed personnel and data processors. In addition, such data may be disclosed to third parties only if specifically appointed as data processors for performing specific services related to existing relationships (e.g., consultants, service companies).
   Data collected using our own cookies will not be disseminated and will not be transferred to third parties. Data collected using third-party cookies may be transferred outside the European Union, specifically to the United States of America.

5. Rights of the data subject

   At any time, you may exercise your rights vis-à-vis the Data Controller, according to Articles 15-22 of EU Regulation 679/2016 (GDPR), and in particular, the rights of access, rectification, integration and, in permitted cases, the portability of the data provided, as well as obtaining the cancellation, restriction or opposition to the processing of the Data for legitimate reasons. As well as the right to complain to the Data Protection Authority pursuant to Article 77 of EU Regulation 679/2016 (GDPR), including by contacting the Data Controller or the DPO, where appointed, in the following ways:

   • by sending a registered letter with a return receipt to the Holder’s address below;
   • by sending an e-mail to fingiatspa@gmail.com.

   In order to ensure the protection of the data subject’s personal information, we may need to request additional specific information which confirms the identity of the requesting data subject and thus guarantees their right to access the information (or to exercise any of the other rights) only to persons entitled to receive such communications. This is another suitable security measure for the protection of personal information.
   Requesting access to one’s personal information (or to exercise any of the above rights) is free of charge. However, if the request is clearly unfounded or excessive, we may charge a reasonable fee considering the administrative costs incurred in providing the information or refuse to comply with the request in such circumstances.
